By accessing, browsing and using our website or any of our applications (collectively, the “Website”) and/or by completing an order, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions (including our Privacy Policy).

The pages of this Website, their content and infrastructure, and the online ordering service made available on and through the Website are owned and operated by Victory Medal Hangers®, operated by XANDER CREATIVE S.R.L. (“we”, “us”, “our”) and are provided for your personal, non-commercial use only, subject to these Terms and Conditions.

We store the contract’s content and will send you details of your order by email. You can view these Terms and Conditions on this page at any time.

Definitions

“victoryhangers.com” means the online store operated under the brand Victory Medal Hangers®, operated by XANDER CREATIVE S.R.L.
“Platform” means the Website (desktop and mobile) and any related online interface or app on which the Service is made available.
“Service” means the online ordering and payment facilitation services for various products as made available by us from time to time on the Platform.
“Account” means the user account you may register on the Website if you choose to submit orders through a personal profile.

Customer Account

To order products, you may create a registered Account on www.victoryhangers.com. You may only register one (1) Account per person.

We reserve the right to delete duplicate Accounts, to deny access or suspend Accounts of Customers who do not comply with these Terms and Conditions, or to edit/remove Accounts as part of our platform administration.

When registering an Account, you will be asked to provide certain personal details. If you do not provide this information, we may be unable to create the Account and you may not be able to place orders via the Account. You are responsible for ensuring that all data you enter is true, accurate, complete and kept up to date. Your personal data will be processed in accordance with our Privacy Policy.

You are responsible for maintaining the confidentiality of your login data (email, password) and for all activities carried out under your Account. If you suspect unauthorized use, you must notify us immediately.

By registering or placing an Order, you warrant that:

• you are at least 18 years old; and
• you have legal capacity to enter into binding contracts.

Effect of These Terms

Nothing in these Terms and Conditions affects your statutory rights (including your right to receive goods that correspond with their description, are fit for purpose and are of satisfactory quality).

These Terms and Conditions override any separate terms put forward by you. Any conditions that you submit or propose in any form are expressly waived and excluded unless we have agreed to them in writing.

No changes to these Terms and Conditions will be binding unless agreed by us in writing. The presence of any product or service on victoryhangers.com at a particular time does not guarantee its availability at any time. We reserve the right to discontinue any product at any time.

Prices and Delivery Charges

Prices displayed on victoryhangers.com are shown in USD (or other currency where indicated) and normally include any applicable Value Added Tax (VAT), unless stated otherwise. Delivery charges, customs duties or import fees (where applicable) are not included in the product price unless explicitly stated.

Before you complete a purchase, you will be clearly informed of the total price of the goods including all applicable taxes and additional charges (such as shipping).

Ordering / Conclusion of Contract

You can place an Order through www.victoryhangers.com. Once you have placed your Order and provided a valid email address, you will receive an email confirmation summarizing your Order. This email confirms that we have received your Order; a Contract is formed once we explicitly accept your Order (usually when we send the shipping confirmation).

If we are unable to fulfill your Order for any reason (e.g., stock issues, payment problems, pricing errors), we will inform you as soon as reasonably possible. If we have already received payment, we will refund the applicable amount using the same payment method you used, unless otherwise agreed with you.

About Customs, Duties and Taxes

When ordering from www.victoryhangers.com, you are responsible for ensuring that the product can be lawfully imported into the destination country.

The recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders shipped outside the European Union (EU) may be subject to import taxes, customs duties and fees levied by the destination country. These charges are typically collected once the shipment reaches the recipient’s country and must be paid by the recipient.

VictoryHangers.com has no control over these charges and cannot predict their amount. Customs policies vary widely from country to country; please contact your local customs office for more information. Customs clearance procedures may cause delays beyond our original delivery estimates.

Delivery

We exercise the utmost diligence in accepting and processing Orders and will endeavor to deliver your Order to the address provided at checkout, in accordance with the shipping method selected.

We aim to dispatch Orders as quickly as possible and in the order in which they are received. Our general goal is to deliver within approximately 3 business days following Order confirmation (depending on destination), unless otherwise communicated. Delivery times are estimates and not guaranteed; delays can occur due to third-party carriers, customs, or other events beyond our control.

If delivery exceeds 30 days from Contract conclusion and this delay is not due to your actions, you may have the right to cancel your Order and receive a refund.

Before you place your Order, you will see the available delivery options and estimated delivery costs. Once your Order has been processed, you will receive an email with your delivery details and (where available) tracking information. If your Order does not arrive by the estimated date, please contact Customer Service at contact@victoryhangers.com.

Withdrawal of Order (Right of Return)

If you are a consumer in the European Union or another jurisdiction providing a statutory cooling-off period, you generally have the right to withdraw from your Order without giving any reason within 14 days from the day you (or a third party indicated by you) receive the last item in your Order.

If you exercise this right, we will refund all payments received from you for the returned items, including the cost of our standard delivery option (if applicable), without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

If you choose to keep certain items and only partially cancel your Order, the delivery cost will not be refunded.

To cancel or return your Order, you must notify us in writing by email at contact@victoryhangers.com and return the item(s) in their original condition and packaging within the 14-day period (unless we provide a longer period in our return policy).

Another payment method may be used for the refund only with your consent; in any case, this will not cause you additional fees. We guarantee a full refund of the returned items provided that all items are returned in the same condition they were in upon your receipt (unused, unwashed, undamaged, with original tags and packaging).

Payment Methods

You can pay for your goods using the methods offered at checkout, which typically include:

Credit or Debit Card

You can enter your payment details when placing your Order using a valid credit or debit card (e.g., Visa or Mastercard). The applicable amount may be reserved (authorized) on your card at the time of placing the Order, but will only be debited when the goods are dispatched. We reserve the right to check the validity of the card, the available credit in relation to the Order value and whether the billing address details are correct. We may refuse Orders based on the outcome of these checks.

PayPal or Other Online Payment Methods

When paying via PayPal or other online payment providers, we reserve the right to verify that the account is valid and sufficiently funded and that the billing details match your information. The applicable amount may be reserved on your account but will generally not be debited until the goods are dispatched. We reserve the right to deny or cancel any purchase if verification fails.

Liability

Nothing in these Terms shall exclude or limit our liability in any way that would be unlawful, including liability for death or personal injury caused by our negligence or fraud.

If we breach these Terms, we will be liable only for losses that are a reasonably foreseeable consequence of that breach. We are not responsible for indirect or consequential losses, including (without limitation) loss of profit, loss of opportunity, data loss or business interruption.

We are not liable for failure to deliver goods or meet other obligations under these Terms where such failure is due to events beyond our reasonable control, including but not limited to fire, flood, storm, riots, civil disturbance, war, terrorism, interruptions to internet or telecommunications services, or actions of third-party carriers.

Our maximum aggregate liability to you for any loss or damage arising in connection with your Order on victoryhangers.com shall be limited to the total price of your Order.

If you have a problem with a product purchased online and cannot resolve your complaint with us, you may (if you are in the EU) use the European Commission’s Online Dispute Resolution (ODR) platform: http://ec.europa.eu/odr.

Guarantee

If there are defects in the goods you have purchased, we abide by all applicable statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods supplied by us, including damage incurred in transit, please notify us as soon as reasonably possible and return the goods to us. We will inspect the product and, where the defect is confirmed, we will repair, replace or refund the item in accordance with applicable law and our policies.

Assignment

We reserve the right to assign or pledge to third parties any claims for payment which have arisen in connection with the delivery of goods (including any installment payments).

Intellectual Property

Unless stated otherwise, the software, design, layout, and all content and materials on the Platform (including text, graphics, logos, images, video, audio, and data compilations) and all related intellectual property rights are owned by Victory Medal Hangers®, XANDER CREATIVE S.R.L., our licensors or our content providers.

We retain exclusive ownership of all rights, title and interest in and to the Platform (including its “look and feel” and infrastructure), any translated content and customer reviews. You are not entitled to copy, scrape, deep-link, publish, promote, market, integrate, combine or otherwise use any part of our content or brand without our express written consent.

Any unauthorized use of our intellectual property may constitute a material infringement and may be pursued under applicable law.

Miscellaneous

To the extent permitted by law, these Terms and Conditions and the provision of our services shall be governed by and construed in accordance with the laws of the country in which Victory Medal Hangers® (XANDER CREATIVE S.R.L.) is established, and any dispute shall be submitted to the competent courts of that country.

If any provision of these Terms and Conditions is held to be invalid, unenforceable or non-binding, the remaining provisions shall continue in full force and effect. In such cases, the invalid provision shall be enforced to the fullest extent permitted, and the parties agree to a term that most closely matches the purpose of the invalid provision.

The original English version of these Terms and Conditions may be translated into other languages. In the event of any inconsistency or dispute regarding the contents or interpretation between the English version and any translated version, the English version shall prevail to the extent permitted by law.
